An elderly man has succumbed to his injuries one week after being involved in a Maryland car accident. According to a CBS Baltimore news report, the fatal crash occurred on Ft. Smallwood Road near Hog Neck Road in Pasadena. Officials say a 1996 Saturn struck the side of a 1999 Chevrolet pickup truck while making a U-turn, forcing the truck to overturn. The 87-year-old passenger in the truck sustained serious injuries that proved fatal. The drivers of both vehicles sustained minor injuries. Investigators have indicated that the Saturn’s driver was at fault.
Many Maryland car accidents are caused by drivers who fail to yield the right-of-way when making a left or U-turn. Under Maryland Transportation Code 21-402, “If the driver of a vehicle intends to turn to the left in an intersection … the driver shall yield the right-of-way to any other vehicle that is approaching.” Additionally, the law states: “If the driver of a vehicle intends to turn to go in the opposite direction, the driver shall yield the right-of-way to any approaching vehicle that is so near as to be an immediate danger.”
Failure to yield to oncoming traffic is a form of driver negligence. The family of someone killed by a negligent driver can file a wrongful death claim to receive financial compensation for their significant losses. A successful wrongful death claim can result in support for:
- Medical bills
- Lost future wages
- Loss of benefits and inheritance
- Loss of companionship
- Pain and suffering
It is not always easy to receive fair compensation following a fatal accident. A skilled Maryland car accident attorney is often needed to protect the rights and best interests of the victim’s family. An attorney can help determine the cause of the crash, calculate the amount of compensation that should be available, and hold the at-fault party responsible for the accident.
