Who Is Responsible?

Traditionally, employers have been held responsible for slip and fall accidents occurring on a job site. To compensate for the inevitable, companies are required by Maryland state law and federal mandate to insure their hires against accidents that may occur on the premises during the regular course of their duties. This is known as workman’s compensation and is the surest way for injured employees to gain financial recompense for medical care following an incident.

However, in the case of a slip-and-fall accident involving scaffolding or ladders at any height, there is the potential for additional legal action. Because of the precarious nature of the work and the high probability of third-party negligence playing a role – due to faulty equipment or shoddy support within the work environment – injured parties are able to pursue both worker’s compensation and a lawsuit at the same time. In order to file a successful personal injury suit, the injured party must prove liability in one of the following ways:

  • The victim must prove that the employer, third party scaffolding supplier or premises owner was fully aware of the dangers the particular site in question posed and took no steps to remedy the situation. This can occur in a myriad of ways, from loose steps to shoddy railings and faulty supports. Whatever the case may be, the owner of the defective and dangerous property had to know of the situation and opted to do nothing about it.
  • The victim must prove that the employer, third party supplier or land- owner directly caused the unsafe conditions that resulted in the victim’s fall. Again, this can occur in a number of ways, but must have been entirely the fault of one or more of the supervising entities.
  • The victim must definitively prove that the employer, third party supplier or property owner should have known about the defective piece of property, because any reasonable manager would have known about it and taken the proper steps to prevent any injuries. This is often a difficult point to prove, as it takes into consideration a person’s “reasonable thought”, but can be quite effective if tackled by a skilled personal injury attorney.
